Marsh will work to promote and monitor implementation of Texas’s Fair Defense Act (FDA). The FDA requires judges in all Texas counties to meet minimum standards for prompt appointment of qualified counsel to represent indigent defendants in criminal cases. Although significant improvements have been made to some county-level indigent defense practices in the almost three years since the FDA was passed, many counties still are struggling to implement all of the statute’s provisions, others are actively resisting its mandates, and the FDA’s potential largely remains unrealized and uncertain. Marsh has been monitoring county compliance with the FDA and working to advance indigent defense reform in Texas since 2001. With her fellowship, Marsh will monitor FDA implementation across Texas, provide technical assistance to counties on issues relating to FDA implementation, and expand her indigent defense reform project by initiating litigation against counties in violation of the FDA. The project will contribute to the growing national movement to reexamine and improve public defense systems across the country.
